Standard Terms and Conditions of Trading

 

These terms form the basis of the contract between our customer and Infusion & Slice. These Terms, your order and your order confirmation are considered by us to set out the whole agreement between you and us for the sale of afternoon teas, cakes and other products. It is your responsibility to check all details in the order confirmation are complete and accurate as this is the document we work to when completing your order.

Basis of Sale

Any samples, pictures, or descriptions we issue, and any descriptions or illustrations contained on our website and social media are issued solely to provide you with an approximate idea of the afternoon teas and cakes they describe and remain the property of Infusion & Slice.

Quotations are valid for a period of 30 calendar days from the day of issue. Whole cake sizes quoted are in portion sizes.  If you would like a specific size in diameter or height, this needs to be requested at the time of booking.

No contract is made with you until we have received your booking fee. Once your booking fee has been received you are in a legally binding contract with Infusion & Slice.

 

The Cakes, Afternoon Teas & other Sweet Treats


We warrant that on delivery or collection the cakes, afternoon teas or any other products shall conform to their description as set out in the Order Confirmation, or as they are described on our website, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK.  When a customer orders a bespoke cake/ afternoon tea, we will not be held responsible for customer disappointment of the design or the interpretation of the product as long as it is made in line with the customer’s pre agreed requirements set out in the order confirmation and will face no consequent liability. It is the customer’s responsibility to ensure all details within the order confirmation are correct and meet their exact requirements.

The warranty does not apply to any defect in the cake /afternoon tea arising from wilful damage, accident, negligence by you or any third party, if you use the cake/afternoon tea in a way we do not recommend, your failure to follow our instructions or any alterations you carry out.

We can never guarantee an exact replica of any cake/afternoon tea we have previously made, as these are all made by human hands and will always have slight differences and variations. 

We don’t mind people showing us images of other cake makers cakes for inspiration, but we will not copy someone else’s cake.  We will always make each cake individual and in the style of Infusion & Slice. It is the customer’s responsibility to make themselves familiar with our style by looking at all cake examples on our website and or asking for more examples.

As our produce is sourced weekly and garnishes can be seasonal they are subject to availability and substitutions, especially fresh flowers.

Where colour swatches are provided, we will do our best to match as close as we deem possible. Exact colour matches are not guaranteed.

From time to time certain materials for our cakes, afternoon teas & other products may become obsolete. This is totally out of our control; however, we will do our best to select replacement products to reflect the original design as closely as possible. We reserve the right to replace items with component parts of equal or better quality without consultation.

Food Allergy Disclaimer

Infusion & Slice is NOT an allergen free kitchen.  We cannot guarantee that our products are free from ingredients that may affect those with food allergies.  While we do have processes in place to minimise the risk of cross-contamination, we cannot give a guarantee that there will be no traces of a particular allergen in our products.  At Infusion & Slice we recognise the seriousness of food allergies and we ask that you contact us before you place an order to inform us of any food allergies that you or your party may have.  We reserve the right to decline any order for clients with serious food allergies.  Infusion & Slice will not assume any liability for adverse reactions to our products.

Due to us working from a home kitchen the following allergens may be present at any one time: 

Celery, Cereals containing gluten, Crustaceans, Eggs, Fish, Lupin, Milk, Molluscs, Mustard, Tree nuts, Peanuts, Sesame seeds, Soybeans(soya), Sulphur dioxide & sulphites. 

If you have a serious allergy to any of these allergens, or one that could cause you to have a major allergic reaction, sadly the only way for you to be 100% safe is not to consume any of our products.

Food Consumption & Storage

Our food products will contain many perishable ingredients and it is our right to assume consumption of these items on the day of delivery/collection.  All non-perishable foods will last up to two days if stored correctly.

All perishable foods -i.e. sandwiches, savouries, and some of our cakes (fresh cream / cream cheese) will need to be kept refrigerated if not consuming just after delivery, to keep them from spoiling.  To enjoy these at their best they should be brought to room temperature just before consuming. It is the responsibility of the client to dispose of the food if kept unrefrigerated after 4 hours to comply with UK food standards. By agreeing to our terms and conditions the client is agreeing to dispose of any food after this set time. We will not be held responsible for any adverse reactions to our food consumed after this time.

All non-perishable foods are best consumed on the day of delivery/collection, but will last up to 1-2 days if kept in their packaging in a cool dark place. Ensure all cut sides are completely covered to prevent the sponge from going dry. 

Infusion & Slice and the customer expressly agree that the cakes and all goods purchased from Infusion & Slice remain the property of Infusion & Slice until paid for in full.

Delivery and Collection

All orders may be collected free of charge from Infusion & Slice by prior arrangement.  The order must be collected on the agreed day and time.  Once collected, the order becomes your responsibility. We cannot be held responsible for any damage caused once it leaves our premises.

Guidance ONLY: when travelling with your goods by car:  You should never place them on a seat, seats are slanted and can damage the goods inside the box.  You should place them in the footwell, or in the boot on a non-slip flat surface and away from any possible items that could fall and damage the products.  The area should also be cool and away from sunlight. Infusion & Slice will take no responsibility for any damage caused once it leaves our premise.

If delivery has been requested, we will deliver on the day set out in the order confirmation to the address provided. We do not offer specific delivery times, but we will do our best to deliver in a specified time slot. Infusion & Slice will always do the best it can to ensure delivery dates agreed are achieved for the provision of the goods or services however the company cannot accept liability for delays and time shall not be of the essence.

If delivery details provided are incorrect, Infusion & slice will not be liable for any delay or failure in delivery of the goods that is caused by your failure to provide Infusion & Slice with adequate delivery instructions or any other instructions that are relevant to the supply of the goods.

If the delivery address changes after the order has been confirmed additional charges may be added to cover extra mileage. 

When the order is being delivered as a gift, it is the responsibility of the client placing the order to make sure the recipient is available to receive the delivery on the day and time agreed.

When delivering to a venue, we may contact the venue in advance to arrange a mutually convenient time for delivery. If we set up the cake / lay the tables / lay out the food, we shall take photographs of the cake / tables/ foods before leaving and, where possible, obtain a signature from the venue confirming that everything has been received in good condition. Should the venue need to set up the cake/tables/food themselves we shall explain how the cake/tables/food is to be displayed and where possible, obtain a signature to verify we have done so. Once the cake/tableware/food has been delivered, we are unable to accept and liability for any damage sustained to the cake/tableware/food thereafter nor any failure to follow the instructions provided.

 

Price and Payment

The price of your cake / afternoon tea / other edibles will be as set out in your order confirmation. No Vat is payable on orders. A £5 booking fee per person is required for afternoon teas.  A 30% booking fee is required for cake orders and all other edibles. 

Please note all booking fees are non-refundable.

All balance payments are due as follows:

Cake orders – 7 days before collection/delivery

Afternoon Tea – up to 10 people = 7 days before collection/deliver 

Afternoon Tea – up to 20 people = 14 days before collection/deliver 

Afternoon Tea – for 21 people and over = 30 days before collection/deliver 

Other edibles - 7 days before collection/delivery

All payment details (including final balance details) will be on the order confirmation. No further payment reminders will be sent, and it is the responsibility of the client to ensure payment is on time.  The balance must be paid in cleared monies no later than the date set out in the order confirmation by cash or bank transfer to the account specified. 

If payment is not received by the date specified this shall be constituted as breach of contract by the client. We reserve the right to hold the order until payment is made in full. When payment is late, we accept no responsibility should we be unable to purchase the required stock or equipment to make the cake or afternoon tea as laid out in the order confirmation. In these circumstances the cake or afternoon tea will be made as close to the order confirmation as possible with no redress or liability on Infusion & Slice.

Prices shown on our website are liable to change at any time.  However, changes will not affect orders in respect of which we have already sent you an invoice.

 

It is possible that, despite our best efforts, some of the products listed on our website may be incorrectly priced due to human error. We are under no obligation to provide the product to you at the incorrect (lower) price. 

 

Cancellation, postponement and alterations

In the event of a cancellation by the customer, charges are as follows;

Cake orders - More than 7days prior to the collection/delivery = booking fee only, less than 7days prior to the collection/delivery = full balance amount

Afternoon Tea – up to 10 people - 7 days before collection/deliver = booking fee only, less than 7 days prior to collection/delivery = full final balance amount. 

Afternoon Tea – up to 20 people - 14 days before collection/deliver = booking fee only, less than 14 days but more than 7 days prior to collection/delivery = booking fee + 50% of final balance, less than 7 days = full final balance amount. 

Afternoon Tea – for 21 people and over - 30 days before collection/deliver = booking fee only, less than 30 days but more than 15 days prior to collection/delivery = booking fee + 50% of the final balance, less than 15 days = full balance amount.

Other edibles - 7 days before collection/delivery = booking fee only, less than 7 days prior to collection/delivery = full balance amount.

The initial booking fee is non-refundable and non-transferable under any circumstances due to time already spent on communication, research and design (in reference to bespoke cakes), and any loss of business due to your booking preventing further bookings on that date. 

You may, prior to the days given above (Cake orders - More than 7days prior to the collection/delivery, Afternoon Tea – up to 10 people - 7 days before collection/deliver, Afternoon Tea – up to 20 people - 14 days before collection/deliver, Afternoon Tea – for 21 people and over - 30 days before collection/deliver), amend your order by providing us with written notice. In the case of alterations, a new order confirmation will be issued detailing the changes and the new cost. Alterations are not confirmed until a new order confirmation has been issued. Should you make any changes after the time scale stipulated above there will be no reduction in the price you pay, even if your new design is cheaper than the original booking. 

Force Majeure


Infusion & Slice shall not be liable for any failure to perform, where such failure or delay results in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, adverse weather, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Infusion & Slice, and Infusion & Slice shall not be liable for any breach of contract resulting from such an event. In this situation we will provide you with written notice and any booking fees paid are non-refundable and we refer to our cancellation policy. 

Infusion & Slice reserves the right to cancel the booking in very unusual circumstances beyond our control, such as ill health of myself or dependants, we will in this instance refund any money taken in full. 

Infusion & Slice’s liability (both in contract and tort) in respect of defects in goods or services shall be limited to the issue of a credit note in respect thereof or granting a refund or other such compensatory measures as Infusion & Slice, at its discretion, considers appropriate in the circumstances and shall be limited to the value of the goods or services giving rise to the claim.

Infusion & Slice shall not under any circumstances be liable for the customer respect of indirect consequential loss or damage or loss of profits, provided always that these conditions do not exclude or restrict Infusion & Slice’s statutory liability for death or personal injury arising from any negligence on Infusion & Slice’s part or liability imposed by statutory implied terms in Consumer Contracts.

 

Tableware Hire, Set up, Clear up

Our tableware is a collection of vintage and vintage style, and other elegant pieces.  Each place setting will have a vintage style matching trio.  Each person’s tableware will be stylishly unmatched. It’s all part of the charm that Infusion & Slice want to share with you. 

All items remain the property of Infusion & Slice at all times.

All items hired from Infusion & Slice remain the responsibility of the hirer, including if left at other premises, until returned or collected. 

 

We ask that you DO NOT wash any of our tableware and never place any of our items in a dishwasher, due to the delicate nature of the items.

 

All items will be delivered clean and carefully wrapped in boxes to prevent breakages and damage, ready to be laid on the table/s.  These items will have been checked for any damage, cracks and chips prior to delivery.  Due to the nature and age of some of the items, there may be signs of wear, such as to gilt, colour/pattern fade, and this is deemed acceptable.  We will not however use anything with chips or cracks. 

Tableware Hire:  as above our tableware will be delivered carefully wrapped in boxes, clean and ready to be laid. Before collection, you must clear plates and empty any liquids, wrap tableware in the towels provided and place in the boxes provided ready to be collected.  As mentioned above please do not wash any of the tableware, leave this to us.

 

‘Set Up’:  We will deliver our tableware and lay it out on your tables at the time of delivery (*excluding food items) If you have not opted for the clear ‘up service’, before collection, you must clear plates and empty any liquids, wrap tableware in the towels provided and place in the boxes provided ready to be collected.  As mentioned above please do not wash any of the tableware, leave this to us. 

* we exclude the laying out of food as it is advisable to keep certain products refrigerated and all food covered, and should only be placed on the table/s once people are seated by the host or waiting staff, unless the food is to be served straight after set up. 

 

‘Clear Up’: We will return at a mutually agreed time to clear your tables of the hired tableware. 

 

Hire Period: The hire period starts at the time of delivery and will end at the mutually agreed time of collection, as set out in the booking confirmation.

Set up and Clear up Delays:  If the Set up or Clear up is delayed by the hirer, a fee of £30 per hour (or part of) will be charged for the delayed period. 

 

When hiring tableware, you will be supplied with the appropriate items for your event, your specific items will be listed on your inventory and will include some or all of the following:

 

cup & saucer, small side plate & cutlery per person 

teapot/s, tea strainer/s

Cake stands or cake/sandwich plates

Sugar bowl, sugar tongs, milk jug

tea jars

Jam and cream jars

napkins

table cloths 

Jugs

Glasses

Inventory: An inventory stating all hired items will be provided by Infusion & Slice, and must be signed by the hirer (or someone made known to us in writing by prior notice) at the point of delivery.  The inventory will provide confirmation of the agreed quantity and condition of the hired items.  This inventory should be used by you to assist in packing the hired items after your hire, to ensure all hired items are to be returned to Infusion & Slice.    

 

Deposit: A deposit against loss or damage (including breakages, chips and cracks) will be required by a separate payment 4 days prior to delivery, via bank transfer.

 

This loss or damage deposit will be returned to the hirer within 4 days of the tableware being returned either in full, or with any deductions made for damaged or lost items.  If damages or loss exceed the deposit, the hirer agrees to pay the excess within 10 working days of the hire period.

 

At the commencement of every hire period you must inspect the hired items and inform us of any missing or damaged items, If you notice any damage to any of the items you must inform us as soon as possible and prior to consuming your food.

 

Refundable deposit fees are as follows:

 

Up to 6 people deposit £100

Up to 12 people deposit £200

Up to 20 people deposit £250

Over 20 – tba (to be agreed)

 

Any damage or loss (accidently or not) will incur the following charges, which we will deduct from your deposit or charged if the deposit amount has been exceeded:

Please return any items that have been damaged, (except glass) so they can be easily identified.

 

Late returns – If for any reason Infusion & Slice are unable to collect the items at the end of the hire period a late fee will be charged

Liability: Infusion & Slice will accept no responsibility in the event of any injury or damages caused by the hired items.

 

Complaints

Complaints are very rare and due to the amount of work put into each individual order we take them very seriously. Any issues must be brought to our attention on the day of delivery in relation to an afternoon tea package or within 48 hours of collection or delivery of a celebration cake, to give fair opportunity to assess the nature of the complaint.

Both Parties agree to not post any negative information about the other arising out of this contract or event on any online forum or website without providing advance written notice of the intended content thereof and providing the other party with a prior opportunity to resolve any issues between the parties amicably.

Complaints regarding the decoration of celebration cake can be easily repaired so errors of this nature must be pointed out upon delivery/collection so as to give us the opportunity to correct them. Once cake has been collected or handed over this confirms that decoration is as requested, and no further claims can be made. 

Where the complaint is in regard to the quality of the cake then the cake, or remainder of the cake/tier, must be returned to us as soon as possible after cutting and within 48 hours (or 24 hours when it is of a perishable nature, fresh cream cake for example) of collection/delivery to ensure that we are able to fairly assess the nature of the complaint.

Please note we can only deal with the client who placed the original order.

 

General Terms 

All designs and intellectual property rights remain the property of Infusion & Slice Ltd

We reserve the right to use images of your cake for any form of advertising including web-based promotions, brochures, galleries and competitions. It is advisable that you make a copy of all documentation received from Infusion & Slice Ltd for your own benefit.

This Agreement together with Order Confirmation documents provided constitute the entire agreement and understanding between the parties relating to the order. Except as may be expressly stated in this Agreement, it supersedes and cancels all prior agreements, statements, representations, understandings, negotiations and discussions, whether oral or written, between the parties. Each of the parties acknowledges and agrees that in entering into this Agreement it does not rely on any statement, representation, warranty or understanding made prior to this Agreement save to the extent that such statement, representation, warranty or understanding is incorporated into this Agreement. Each of the parties acknowledges and agrees that in entering into this Agreement it has not relied on (or has been induced to enter into this Agreement by) any statement, representation, warranty or understanding made prior to this Agreement. Nothing in this paragraph excludes any liability for fraudulent misrepresentation.

In the event that any one or more such provisions of this agreement should be deemed to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity and enforceability of the remaining valid and enforceable provisions thereof which shall be construed as if such invalid or unenforceable provisions had not been inserted.

The parties agree to submit to the non-exclusive jurisdiction of the English courts.

Any headings utilised in this agreement have been inserted for the convenience of reference only and should in no way restrict or otherwise affect the construction of the terms and conditions hereof.

While we endeavour to ensure that the information on our website is correct, we do not warrant the accuracy or completeness of the material on our website. We may make changes to the material on our website or to any services or prices described in it, at any time without notice. The material on our website may be out of date, and we do not make any commitment to update this material.
